2. Acceptance of Terms

You represent and warrant that you have the legal capacity to enter into these Terms in accordance with the laws of India. If you are under 18 years of age, you are prohibited from using our Service.

3. Eligibility

You must be at least 18 years old to use UniDate. By using the Service, you represent and warrant that:

  • You are at least 18 years old;
  • You have not been convicted of or pled no contest to a felony or indictable offense (or crime of similar severity), a sex crime, or any crime involving violence;
  • You are not required to register as a sex offender with any state, federal or local sex offender registry;
  • You are not prohibited by law from using our Service;
  • You are not using this Service to promote illegal activities;
  • You will comply with all applicable laws, regulations, and rules within India and any other relevant jurisdiction.

4. Account Registration

To use certain features of the Service, you must register for an account with us ("User Account"). When you register, you agree to:

  • Provide accurate, current, and complete information;
  • Maintain and promptly update your account information;
  • Maintain the security of your account credentials;
  • Be responsible for all activities that occur under your account;
  • Immediately notify us of any unauthorized use of your account or other security breaches.

We reserve the right to refuse registration, terminate accounts, or remove or edit content at our sole discretion.

5. User Content

You retain ownership rights to the content you submit to the Service ("User Content"). However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your User Content in any existing or future media.

You represent and warrant that:

  • You own or have the necessary rights to the User Content you submit;
  • Your User Content does not infringe upon the rights of any third party, including intellectual property rights or privacy rights;
  • Your User Content complies with these Terms and applicable laws.

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable at our sole discretion.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law;
  • Violate or encourage others to violate the rights of third parties, including intellectual property rights;
  • Post, upload, or share content that is fraudulent, false, misleading, or deceptive;
  • Create multiple accounts or accounts on behalf of someone other than yourself;
  • Impersonate any person or entity;
  • Harass, bully, stalk, intimidate, or defame any other user;
  • Post or share content that is obscene, pornographic, violent, or otherwise offensive;
  • Engage in commercial activities without our prior written consent;
  • Use the Service to promote or advertise services without our prior written consent;
  • Use the Service to collect or harvest any personally identifiable information from other users;
  • Use the Service to transmit any malware, spyware, or other harmful code;
  • Interfere with or disrupt the Service or servers or networks connected to the Service;
  • Attempt to gain unauthorized access to any portion of the Service;
  • Use the Service to promote or arrange offline meetings or activities with other users without their explicit consent.

7. Subscription Plans and Payments

UniDate offers both free and paid subscription options. By purchasing a subscription, you agree to the following:

  • You authorize us to charge your chosen payment method for the subscription fee plus any applicable taxes;
  • Subscriptions will automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date;
  • You are responsible for all charges incurred under your account;
  • All fees are non-refundable except as expressly set forth in these Terms or as required by applicable law;
  • We may change subscription fees upon notice. Any price changes will take effect at the start of the next subscription period.

Payments are processed securely through our payment processors in compliance with applicable laws and regulations in India, including the Payment and Settlement Systems Act, 2007.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your use of the Service by deactivating your account through the account settings or by contacting us. Upon termination:

  • Your right to use the Service will immediately cease;
  • We may delete or anonymize your account information and User Content;
  • Any subscription fees paid are non-refundable unless required by law.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by UniDate and are protected by copyright, trademark, and other intellectual property laws of India and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location;
  • Any errors or defects will be corrected;
  • The Service is free of viruses or other harmful components;
  • The results of using the Service will meet your requirements.

We are not responsible for verifying the identity or intentions of users and we cannot ensure that a user will actually complete a meeting or behave appropriately. Users are solely responsible for their interactions with other users.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL UNIDATE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
  • ANY CONTENT OBTAINED FROM THE SERVICE; OR
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless UniDate and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Service;
  • Your violation of these Terms;
  • Your violation of any third-party right, including any intellectual property or privacy right;
  • Any claim that your User Content caused damage to a third party.

13. Dispute Resolution

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be resolved through good faith negotiations between the parties.

If the dispute is not resolved within 30 days of initiating negotiations, either party may initiate formal legal proceedings in the courts of India.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in [Your City], India, and you hereby consent to the personal jurisdiction and venue therein.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

  • Imagery featuring weapons, drugs, or other prohibited items

Profile photos should:

  • Clearly show your face
  • Be recent and authentic
  • Not include other people without their permission
  • Not display contact information
  • Not be overly suggestive or explicit

7. Reporting Violations

If you encounter content or behavior that violates these guidelines:

  • Use the in-app reporting feature to report the user or content
  • Provide specific details about the violation
  • Block users who make you uncomfortable

We review all reports and take appropriate action based on the severity and frequency of violations. Your reports are confidential, and the reported user will not be informed about who reported them.

8. Enforcement

We enforce these guidelines through various measures, including:

  • Content removal
  • Warnings
  • Temporary suspension
  • Permanent account termination
  • Reporting to legal authorities when necessary

The enforcement action taken depends on the nature and severity of the violation, as well as the user's history of compliance with our guidelines.
